If you’ve been following our blog posts over the past few years, you’ve likely noticed a standard disclaimer at the end of each entry. It reads in part, “Please consult an attorney for advice about your individual situation. The material on this website and in this or any blog article we publish are for informational purposes only and do not constitute legal advice.”
You might think, “But wait. Isn’t legal information and legal advice the same thing?” No. In fact, they couldn’t be more different.
Legal Information vs. Legal Advice
Legal information educates and informs on a broader scale. Think in terms of the generalized information you might see on a website, blog post, television commercial, social media, and even brochures and pamphlets. Nowhere in there does the information address your unique situation or provide solutions. Or, at least, it shouldn’t! Instead, the intent is to speak to a larger audience about a particular topic, legal term, service, or scenario.
You can find legal information anywhere, and the goal is to ensure you’re getting it from a qualified source. That said, there are a few reasons why you shouldn’t rely solely on legal information:
- Legislation and laws change all the time
- New legal precedents take place every day
- Legal information isn’t tailored to your circumstances or situation
- It is merely one person’s understanding of the law
If that legal information is credible and relatable to your situation, it will hopefully spur you to seek legal advice.
Legal advice is where you will sit down with an attorney to discuss your specific legal situation and receive a formal opinion (advice) on what to do next based on the law and the facts of your case. Providing legal advice is a serious matter and requires the person giving it to have the appropriate education, training, experience, and legal knowledge to apply specific laws to a particular set of circumstances. Providing inaccurate or harmful legal advice can impact a person’s legal rights and the outcome of their case.
Legal advice has many forms, including:
- A professional opinion on your case
- Advising on potential outcomes of a case and how best to move forward
- Representing you and negotiating for you in and out of Court
- Information-gathering and drafting legal documents
