What Is the Process for a Legal Name Change?
The easiest way to complete a name change (such as switching back to your maiden name) is to include the name change request in your divorce decree. This is not automatic and must be formally requested, but doing so during the divorce versus waiting until after the divorce is final eliminates the need for a separate proceeding and additional costs.
From there, simply use the divorce decree as legal evidence to properly update all your IDs and pertinent documents with other entities. This includes your driver’s license, social security card, passport, government-issued IDs, etc.
It is also noteworthy that if you ultimately decide not to go back to your maiden name during the divorce, you can later do an adult name change through a Petition to Change Name of an Adult. This is a separate case, so changing your name during the divorce has obvious cost and streamlining benefits.
