Many couples considering divorce might think a judge will automatically grant it when the time comes with no reasons required and no questions asked. The good news is that Texas has made it relatively easy to prove acceptable grounds for divorce.
What are grounds for divorce?
Grounds for divorce are exactly what they sound like — the specific reason that led to you and your spouse choosing divorce for your unique situation. Many couples may be able to point to one specific situation that caused the breakup, while others may find their reasons to be more complicated. In some situations, no one is to blame.
In Texas, there are two classifications to consider regarding grounds for divorce: No-Fault Grounds and At-Fault Grounds.
No-fault grounds for divorce simply mean that neither spouse has to prove that the other spouse did something wrong to cause the breakup. You’re simply stating that you can’t get along, and there’s no hope for a reconciliation.
Examples include:
- Personality conflicts that can’t be overcome
- Too much discord or conflict
- Irreconcilable differences
Meanwhile, at-fault grounds for divorce mean that one or both parties did something (a specific action or behavior) that led to the decision to divorce.
Examples of at-fault grounds for divorce include:
- You or your spouse committed adultery
- An abusive relationship exists
- You or your spouse were convicted of a felony and sent to prison
- Abandonment
